Mr. Staferton. The mocion you make now, to referre the difference betweene vs concerning the base tenures, to a conference of your counsaile and mine, is no other then I my self offered allmost a yeere since in open court to the Tenants, and which they have ever since neglected. And allthough I might Justly refuse now, that which you have all refused so long, yet to be constant to mine own purposes, which have ever bin rather to recover my right in freendly mannor then by sute of law (allthough I hold the course by law, as free and Iust for mee as yt is for you) I am contented to imbrace your mocion, but with this condicion, that yt shall not be vsed as a meanes to delay me or defeate me of my tryall. Therefore I will not deliver the cattle but vpon a replevin, or such a condicion as I proposed in my last letter vnto you. But when the replevin is brought, I will give you my promise not to proceede in the sute, till our councell hath mette & conferred. And for the conference I will nominat the first 4 daies of the next Terme. yf this like you, I have given this bearer order to deliver the cattle. yf not, you must take som course for their keeping heereafter in the pound. for I will not stand charged any way with them. All this controversy notwithstanding, I will continue the same mind towards you which I mentioned in my former letter.
